Bill supported by lawyers in Kentucky that requires screening before employment of workers in the nursing home

Perform a check of each applicant for nursing home Fund work could protect thousands of vulnerable residents of greater abuse, say increased abuse of Bowling Green and neglecting lawyers. Marshall j. Hughes and Lee Coleman.

All nursing home employees may be subject to background checks if you pass a prefiled Bill in the legislature of Kentucky at the meeting of 2012, according to a recent article in the Lexington Herald-Leader.

Existing laws require only background information on employees who provide direct greater care in nursing homes. The new draft law extends the scope to include any person who works in facilities, regardless of the degree of accuracy that interact with the residents.

"Extending the statute can provide greater protection for a population of elderly who cannot speak for themselves when they abused them," said lawyer of personal injury from Bowling Green Marshall j. Hughes, whose law firm has extensive experience in handling cases of elderly abuse and increased oversight in Bowling Green, Louisville and parts of Tennessee.

"Any employee, not only those who provide direct care to nursing home residents, still have many opportunities to exploit them only because they are in such close proximity", added.

The new draft law comes on the heels of another movement of Kentucky to resolve the cases of elderly abuse. In June, the Centers for Medicaid and Medicare services with the State a grant of $ 3 million to upgrade its system of verification of background to one that seeks only his name to one that displays to potential employees by fingerprint.

"Could be a preventive measure excellent," said lawyer Lee Coleman, who also handles trials of death arising from major abuses and personal injury.

"And because fingerprints are sent to the police of the State and the FBI for criminal records, the selection process will be wider and hopefully reduce the instances of more abuse," said the lawyer for personal injury of Bowling Green.

But friends and family members should still keep a watchful eye for signs of abuse of older people, both caution of lawyers in Kentucky.

"Background checks only can go so far in the prevention of cases of abuse of elderly people," says Coleman. "For example, is what happens to offenders who have a clean record, but start abusing elderly later hired?" "Attentive to the signs of abuse or neglect is everyone's responsibility".

Possible signs of further abuse may include:

"Please note that better meets your loved" advises Coleman. "May not necessarily see the typical symptoms, but other behaviors or physical changes that are incompatible with their status". "If the suspicions are housed, it is best to investigate or to contact one lawyer experienced more abuse to make sure that you get the answers you deserve".

In fiscal year 2010, the Kentucky Department of community services was 13,491 reports of alleged abuse of people older than 60, the highest number of complaints it has received since the beginning of the communication of data in 2006, according to the State Cabinet for the annual report of health and family services.

"With strict enforcement and the intensive campaign of promotion, this new legislation can reduce that number even more," says Hughes. "The largest population in Kentucky nursing home deserves nothing less than the best quality of life in their golden years".
